As recognised nuisance experts NACE have developed and designed a professional ‘Evidence Surveillance Plan’ suitable for anyone suffering from either a domestic or a commercial smoke and/or fume nuisance where critical evidence is absolutely essential. 

The general public can no longer rely on their local authority or Environmental Health for support as these government departments are now run on a shoestring and with far less people, those who are prepared to look into a smoke and/or fume nuisance are woefully inexperienced and technically far from competent to do so, if it isn’t viable for an Environmental Health officer to issue an abatement notice nothing more will be done, however, there is of course a great deal more than can and should be considered if the nuisance persists.

Environmental Health officers refer with regard to a smoke and/or fume nuisance to the requirements of the EPA, (Environmental Protection Act Part 3) there may be times when the CAA is also referred to. (Clean Air Act) Both statutory documents are regularly misinterpreted, this is of no help to the consumer when faced with a neighbour related nuisance which often spirals into a registered dispute which can and will affect the selling of a property. 

Environmental Health officers are not in the business of mitigating or resolving a nuisance, they are primarily concerned with its existence, if it causes a change in a complainants lifestyle or enjoyment or the nuisance is continuous and thus invasive an abatement order may be served, however, these are potentially contentious and expensive to issue without considerable evidence required to prove guilt beforehand!

The NACE ‘ESP’ can and will assist the recipient of a nuisance to gather sufficient levels of evidence necessary to bring about a private summons if the nuisance cannot be mitigated through conventional means.

The ESP system is a combination of CCTV design, positioning and the recording of evidence both visual and sensory, monitoring equipment capable of detecting and recording physical smoke, VOC’s, PM2.5+ and other lethal toxins/carcinogens found in wood smoke, food cooking and coal by products.

NACE also provide court acceptable witness documentation, inspection and investigative services to support intended litigation, this of course is a part of a much bigger physical and administrative support system available to the consumer.
